America & Beyond, LLC ("America & Beyond," "A&B Wholesale," "we," "us," or "our") respects your privacy. This Wholesale Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit americaandbeyondwholesale.com or another wholesale site on which this Policy is posted; apply for, administer, or use a wholesale account; place or manage wholesale orders; communicate with us; attend trade shows or appointments; or otherwise interact with our wholesale business (collectively, the "Wholesale Services").
This Policy applies to individuals, including sole proprietors and representatives, owners, employees, agents, and contacts of wholesale applicants, retailers, boutiques, distributors, vendors, and other business partners. It does not govern America & Beyond’s consumer retail website or personal retail purchases, which are subject to the retail Privacy Policy posted on americaandbeyond.com. If a different notice is presented at collection, that notice supplements this Policy.
America & Beyond is the business or controller responsible for the personal information described in this Policy, except where another entity is identified at collection. Some privacy laws exclude information processed solely in a business-to-business or employment context or apply only when statutory thresholds are met. Where a law applies, we provide the rights and disclosures it requires. We may also honor requests voluntarily where feasible.
The Wholesale Services are intended for qualified businesses and their adult representatives. They are not intended for consumers making purchases for personal, family, or household use.
Business-license, tax, resale, bank, payment, login, and similar information may be sensitive or confidential even when it is not legally classified as sensitive personal information. We limit its use to purposes reasonably necessary to verify eligibility, administer the relationship, complete transactions, protect accounts, prevent fraud, comply with law, or another purpose disclosed at collection. Please do not provide personal Social Security numbers, personal health information, precise geolocation, biometric identifiers, or other sensitive personal information unless specifically requested and legally necessary.

Depending on location and applicable law, we request consent before using nonessential technologies or provide an opt-out. Available choices may be reviewed or changed through the cookie-preference tool or privacy-choice link in the website footer. Browser settings may not affect all technologies, and disabling some technologies may reduce functionality.
Where required by applicable U.S. state law, we process a recognized opt-out preference signal, such as Global Privacy Control (GPC), as a request to opt out of sale, sharing, or targeted advertising for the browser or device sending the signal. We do not separately respond to legacy Do Not Track signals because no uniform standard governs them.
Third-party commerce, analytics, advertising, social-media, and service providers may process information through the Wholesale Services. Their independent processing is governed by their own notices. The current technologies used should be reflected in the cookie-preference tool; cookie names and durations may change as platforms are updated.
We do not sell personal information for money. Some laws define "sale" broadly, and California defines "sharing" to include disclosure for cross-context behavioral advertising. Advertising and analytics technologies may be considered a sale, sharing, or processing for targeted advertising involving identifiers, commercial information, internet or device activity, approximate location, and inferences. Where applicable, you may opt out through the privacy-choice link in the website footer, a recognized signal such as GPC, or Section 11.
We do not knowingly sell or share personal information of individuals under 16. The Wholesale Services are intended for adult business representatives and not children.
Certain U.S. privacy laws exclude or limit rights for personal information processed solely in a commercial or employment context. When such an exemption applies, the rights below may not apply to information processed solely because you represent a wholesale business. They may still apply to website browsing, advertising identifiers, or information processed outside the exempt context.
During the preceding 12 months, we may have collected the following California statutory categories: identifiers; customer-record information; characteristics protected by law only if voluntarily provided and legally relevant; commercial information; internet or network activity; approximate geolocation; audio, electronic, visual, or similar information; professional or employment-related information; inferences; and sensitive personal information only as described in Section 2. Sections 2 through 7 describe examples, sources, purposes, recipients, and sale/sharing practices. We may have disclosed these categories for business purposes. We may have sold or shared identifiers, commercial information, internet or device activity, approximate location, and inferences through advertising or analytics technologies.
Where the CCPA applies and no exemption controls, California residents may request to know or access, delete, or correct personal information; opt out of sale or sharing; limit qualifying uses or disclosures of sensitive personal information; and receive equal treatment without unlawful retaliation or discrimination. We do not use sensitive personal information to infer characteristics or for purposes triggering the right to limit unless we provide the required notice and mechanism.
Subject to residence, applicability thresholds, exemptions, verification, and exceptions, residents of states with comprehensive privacy laws may have rights to confirm processing and access information; correct inaccuracies; request deletion; obtain portability; opt out of sale, targeted advertising, or qualifying profiling; withdraw consent to certain sensitive-data processing; obtain information about certain third-party disclosures; and appeal a denial where required.
We do not use personal information for profiling in furtherance of decisions that produce legal or similarly significant effects, as those terms are defined by applicable privacy law. We may use automated tools to detect and prevent fraud, assess transaction or credit risk, verify wholesale eligibility, and protect the Wholesale Services. Where required by law, we provide information about automated decision-making and available rights, including human review.
Where European data-protection law applies, America & Beyond, LLC is the controller unless otherwise stated.
Subject to conditions and exceptions, individuals may request access, rectification, erasure, restriction, portability, or objection; object to direct marketing at any time; withdraw consent; and complain to the supervisory authority where they live, work, or believe an infringement occurred. Individuals also have rights concerning solely automated decisions producing legal or similarly significant effects. We may use automated fraud, credit-risk, or eligibility tools, but we do not use personal data for solely automated decisions producing such effects except as disclosed and permitted by law. Where applicable, you may request information and human review.
Information identified as required in an application, transaction, or compliance process generally is necessary to evaluate or administer the wholesale relationship, enter into or perform a contract, or comply with law. If it is not provided, we may be unable to approve an account or complete a transaction. We and our providers may process information in the United States, India, the EEA, UK, Canada, or other countries. Where required, we use adequacy decisions, Standard Contractual Clauses, the UK transfer addendum or agreement, or another lawful safeguard. A copy or description of applicable safeguards may be requested. Any legally required EU, UK, or Swiss representative will be identified in Section 17 or a supplemental notice.
Where Canadian privacy law applies, we are accountable for personal information under our control; identify appropriate purposes; obtain meaningful consent where required; limit collection, use, disclosure, and retention; use reasonable safeguards; and maintain openness about our practices. Subject to applicable law and exceptions, individuals may request access or correction, withdraw consent to future processing, and challenge compliance. Withdrawal may prevent us from maintaining an account or providing requested Wholesale Services. Information may be processed outside Canadaand may be accessible to authorities under local law. Unresolved complaints may be directed to the
Office of the Privacy Commissioner of Canada or an applicable provincial regulator.

We may verify identity, authority, and business association using proportionate information such as control of the relevant email address, account details, transaction information, or signed authorization. We will not routinely require a passport or utility bill when a less intrusive method is sufficient. An authorized agent may submit a request where permitted; we may require proof of authority and direct verification with the individual.
We respond within applicable legal timeframes. California verifiable consumer requests generally receive a response within 45 days, subject to a permitted extension with notice. EEA and UK requests generally receive a response within one month, subject to permitted extensions. Where an appeal right applies, our response will explain the appeal process and any required regulator contact. We ordinarily do not charge a fee, but may charge or decline to act where legally permitted for manifestly unfounded, excessive, repetitive, or technically infeasible requests.
We retain personal information only as long as reasonably necessary and proportionate for the purposes described in this Policy, including providing Wholesale Services, maintaining business and transaction records, complying with legal obligations, preventing fraud, collecting amounts owed, resolving disputes, and preserving or defending legal claims. We consider the nature and sensitivity of information, risks, processing purposes, available alternatives, contractual requirements, and applicable law.

The Wholesale Services are intended only for adult business representatives and are not directed to children. We do not knowingly collect personal information online from children under 13 or knowingly sell or share personal information of individuals under 16. If you believe a child has provided information, contact us and we will take appropriate steps.
The Wholesale Services may link to or integrate payment, shipping, freight, customs, social-media, trade-show, appointment, or other third-party services. A third party’s independent processing is governed by its own privacy notice. Review that notice before providing information. This Policy does not govern information independently collected by a retailer, marketplace, freight forwarder, trade-show organizer, or other unaffiliated party.
We may update this Policy to reflect changes in our practices, technology, Wholesale Services, or legal obligations. We will post the revised Policy and update the "Last Updated" date. If required, we will provide additional notice or obtain consent before a material change takes effect.
