This Shipping, Returns & Refund Policy applies to all wholesale purchases made from America & Beyond. By applying for a wholesale account or placing an order, the purchaser acknowledges that they have read, understood, and agree to be bound by this Policy.
America & Beyond is a wholesale supplier of fashion apparel, handbags, accessories, and lifestyle products. We sell exclusively to qualified retail businesses and boutiques and do not sell directly to consumers.
To open a wholesale account, applicants must provide:
A valid business license or proof of retail operation
A resale certificate / sales tax exemption certificate, where applicable
Any additional documentation reasonably requested by America & Beyond to verify eligibility
America & Beyond reserves the right to approve or decline any wholesale account application at its sole discretion. Orders will not be processed until an account has been approved.
Where a valid resale certificate is not provided, America & Beyond reserves the right to charge applicable sales tax on the order.
Minimum opening order: USD $500.00
Minimum reorder: Reorders must meet a minimum of USD $350.00 (or applicable case-pack minimums, whichever is greater) unless otherwise agreed in writing.
Orders must be placed in applicable case-pack quantities or minimum order quantities. America & Beyond reserves the right to adjust order quantities to comply with packaging or production requirements.
Prices and Manufacturer's Suggested Retail Prices (MSRP) are subject to change without prior notice due to fluctuations in raw material costs, labor, freight, tariffs, currency exchange rates, or other market conditions.
Buyers agree to:
Sell purchased merchandise at or above any Minimum Advertised Price (MAP) communicated by America & Beyond, where applicable
Resell merchandise only through the buyer's own approved retail channels (in-store and/or the buyer's own branded e-commerce site), unless otherwise authorized in writing
Refrain from reselling merchandise on third-party marketplaces (e.g., Amazon, eBay, Walmart Marketplace, discount/closeout sites) without prior written authorization from America & Beyond
Violation of this section may result in suspension or termination of the wholesale account at America & Beyond's discretion.
Many of our products are handcrafted and manufactured specifically for each order. Estimated production and shipping dates provided at trade shows or during order confirmation are estimates only and may change due to:
Artisan production schedules
Availability of raw materials
Quality control requirements
Seasonal demand
Shipping and customs delays
Circumstances beyond our reasonable control
Because products are made to order, cancellations will not be accepted within 30 days of the scheduled ship date unless approved in writing by America & Beyond.
All opening orders must be prepaid unless otherwise approved by America & Beyond in writing.

Orders are not considered confirmed until the required deposit or full payment has been received. Delayed or incomplete payments will delay production and shipment.
In the event of non-payment, the Customer agrees to reimburse America & Beyond for all reasonable collection costs, attorney's fees, court costs, and related expenses to the extent permitted by applicable law.
America & Beyond reserves the right to select the shipping carrier and shipping method unless alternative routing instructions — including use of the Customer's own freight forwarder — are agreed upon in writing before shipment. Customers using their own freight forwarder are responsible for coordinating pickup and any related costs.
Shipping charges are invoiced separately and are payable by the Customer.
All orders are shipped from India. Unless otherwise agreed in writing, shipments are made FOB Origin (India) — title and risk of loss pass to the Customer upon delivery of goods to the carrier. America & Beyond recommends Customers arrange shipping insurance for high-value shipments.
The ship date represents the date on which merchandise leaves our warehouse. It does not represent the delivery date.
Typical transit times are approximately 10–14 business days after shipment; however, delivery times are estimates only and are not guaranteed.
Delivery may be delayed due to customs inspections, weather conditions, transportation disruptions, carrier delays, governmental actions, or other circumstances beyond our control. America & Beyond shall not be liable for delays caused by third-party carriers or customs authorities.
International Duties & Customs: The Customer is solely responsible for all customs duties, import taxes, brokerage fees, and other government-imposed charges associated with importing merchandise into the destination country, unless otherwise agreed in writing.
Insurance: America & Beyond recommends that Customers arrange cargo/transit insurance for all shipments. For orders exceeding USD $2,500 in value, transit insurance is required prior to shipment, and a minimum insurance charge will apply to such orders.
Price Adjustments on Unshipped Orders: In the event of a significant increase in raw material, labor, freight, tariff, or currency costs occurring after an order is placed but before it has shipped, America & Beyond reserves the right to adjust pricing on the unshipped portion of that order accordingly. Customers will be notified of any such adjustment and may cancel the affected unshipped portion within 5 business days of notice without penalty.

Order changes or cancellations become effective only after written approval from America & Beyond.
Unless otherwise agreed in writing:
Backordered merchandise may ship within 30 days of the original scheduled shipment date.
Orders that have entered production or are already in transit cannot be cancelled.
Refunds will not be issued solely because merchandise ships as a backorder within the permitted period.
Customers refusing delivery remain responsible for:
Original shipping charges
Return freight charges
Applicable restocking fees
Any additional costs incurred by America & Beyond
All returns require prior written authorization and a valid Return Merchandise Authorization (RMA) number.

Returns received without an authorized RMA may be refused.
Claims relating to damaged merchandise, shortages, manufacturing defects, or incorrectly shipped products must be submitted in writing within seven (7) calendar days after receipt of the shipment.
America & Beyond may require photographs or additional documentation before approving any claim.
The following are final sale and not eligible for return, exchange, or credit, unless they arrive damaged, defective, or incorrect:
Sample and showroom units
Closeout, clearance, and discontinued merchandise
Custom or private-label orders made to a buyer's specification
Approved returns must:
Be shipped within 14 calendar days after the RMA has been issued.
Be unused, unwashed, unworn, and in original resalable condition.
Include original packaging, labels, tags, and accessories.
Garment Defects: If a garment is received with a manufacturing defect, only the individual size(s) or unit(s) confirmed to be defective will be eligible for replacement or merchandise credit. The remaining garments within the pack that are not defective are not eligible for return, replacement, or credit.
If the entire pack is determined by America & Beyond to be defective due to a manufacturing issue, the complete pack may be approved for replacement or merchandise credit at our sole discretion.
Merchandise that has been altered, washed, steamed, worn, damaged after delivery, or returned without original packaging may be refused or may receive only partial credit. Merchandise rejected under this section will be returned to the Customer at the Customer's expense, or disposed of, at America & Beyond's discretion, if not reclaimed within 30 days of rejection notice.
Approved returns are subject to the following:
Standard approved returns: 20% restocking fee
Returns involving broken case packs, customer-used merchandise, damaged packaging, washed or steamed items, or merchandise requiring additional processing may be subject to:
A restocking fee of up to 50%, or
Rejection without credit.
America & Beyond reserves the sole right to determine the condition and eligibility of returned merchandise.
America & Beyond does not issue cash refunds on wholesale orders, including for approved returns, damaged, defective, or incorrect merchandise.
All approved claims will be resolved exclusively in the form of store credit toward a future purchase, at our sole discretion. Store credit is valid for twelve (12) months from the date of issuance and may be applied toward the Customer's next qualifying order of USD $350.00 or more.
Due to the handmade nature of these products, slight variations in color, texture, weave, finish, dimensions, and natural characteristics are normal and should not be considered defects.
Such variations do not qualify for returns, exchanges, credits, or warranty claims.
Customer is responsible for ensuring that resold merchandise complies with all applicable laws, labeling requirements, and safety standards in the jurisdiction(s) where it is resold. In the event a product recall or compliance issue arises due to a confirmed manufacturing defect, America & Beyond will cooperate in good faith on remedial action; however, America & Beyond's liability in connection with any recall shall not exceed the purchase price of the affected merchandise, except to the extent otherwise required by applicable law.
Wholesale pricing, catalogs, line sheets, and related materials provided to the Customer are confidential and intended solely for the Customer's internal use in evaluating and placing orders. Customers agree not to disclose or distribute this pricing information to end consumers or unauthorized third parties.
Customer may not assign, transfer, or delegate its wholesale account or any rights or obligations under this Policy, whether by sale of business, change of control, or otherwise, without America & Beyond's prior written consent. Any attempted assignment in violation of this section is void.
America & Beyond reserves the right to suspend or terminate a wholesale account, at its sole discretion, in the event of non-payment, unauthorized resale (including violations of Section 2), breach of this Policy, or other conduct America & Beyond determines to be detrimental to its brand or business relationships. Termination does not relieve the Customer of any outstanding payment obligations.
EXCEPT AS EXPRESSLY STATED IN THIS POLICY, ALL MERCHANDISE IS SOLD "AS IS," AND AMERICA & BEYOND DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
America & Beyond shall not be responsible for delays or failure to perform resulting from events beyond its reasonable control, including but not limited to natural disasters, pandemics, labor shortages, transportation interruptions, customs delays, governmental actions, war, terrorism, strikes, or shortages of raw materials.
To the fullest extent permitted by applicable law, America & Beyond shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the purchase, shipment, delay, or use of its products.
America & Beyond's maximum liability shall not exceed the purchase price actually paid for the merchandise giving rise to the claim, and Customer agrees to indemnify and hold harmless America & Beyond from third-party claims arising out of Customer's resale or misuse of the merchandise.
This Policy shall be governed by and interpreted in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
The parties agree to first attempt to resolve any dispute arising from this Policy through good-faith negotiation, followed by mediation if negotiation fails. If a dispute remains unresolved after mediation, it shall be subject to the exclusive jurisdiction of the state or federal courts located in Florida, unless otherwise required by applicable law or unless the parties separately agree in writing to binding arbitration.
All formal legal notices under this Policy (including notices of breach, termination, or dispute) must be sent in writing to the addresses on file for each party and shall be deemed received 3 business days after mailing, or upon confirmed email delivery if sent to the designated contact. Routine order-related communications (RMAs, order changes, etc.) may continue to be handled by email as described elsewhere in this Policy.
Customer agrees that orders, RMA requests, approvals, and related communications conducted via email or through America & Beyond's online systems are legally binding and constitute a valid electronic signature/consent to the same extent as a handwritten signature.
America & Beyond's failure to enforce any provision of this Policy, or delay in doing so, shall not be construed as a waiver of that provision or of America & Beyond's right to enforce it at a later time.
Sections relating to Confidentiality, Product Compliance & Recalls, Indemnification, Limitation of Liability, Warranty Disclaimer, and Governing Law & Dispute Resolution shall survive the termination or expiration of the wholesale relationship for any reason.
If any provision of this Policy is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. This Policy, together with any order confirmation, constitutes the entire agreement between the parties regarding wholesale shipping and returns and supersedes any prior understandings on this subject.
America & Beyond reserves the right to amend or modify this Policy at any time without prior notice. The version published on our website at the time an order is placed shall govern that transaction.
